GOVERNING LAW AND JURISDICTION
The Terms shall be governed by Italian substantive Law, without regard to the International private Law provisions. All disputes, which may arise from the application, interpretation or execution of the Terms, shall be exclusively settled in the Courts of Milano, Italy.
SERVICE AND DISCLAIMER
Upon utilization of the Certilogo Seal of Authentication (SoA) offered to online sellers, you (i) agree that you will use the SoA exclusively for products of which you are the legitimate owner, (ii) declare that you have bought or otherwise received those products from authorized sellers, (iii) assure that you will accurately follow the instructions provided for the use of the Seal of Authentication (SoA) and (iv) declare that you will accept the outcome of the service provided by Certilogo (Service).
PRIVACY
In order to use the Service, users have to accept the Terms and, by accepting the Terms, users also agree that Certilogo will treat their personal data according to Italian Law provisions (D. Lgs. 196/2003). Further details regarding data treatment by Certilogo are provided in our Privacy Statement, that you can find below.
INTELLECTUAL PROPERTY
All content and trademarks provided on this site is owned by or licensed to Certilogo and protected by Italian and international intellectual property laws. Certilogo and its licensors retain all proprietary rights to the Certilogo Content. The content and trademarks may not be reproduced, transmitted or distributed without the prior written consent of Certilogo.
By making available any content (such as videos, photos, writings) on this site, users grant Certilogo the free license to use, store, reproduce and modify such content for the purpose of providing the Service. Such license will automatically terminate upon cancellation of the user's account or removal of the content from this site.
ABUSE AND IMPROPER USE OF THE SERVICE
You agree that you will not abuse of or make improper use of the Service and therefore agree (a) that you will not use any robot, spider, scraper, or other automated means to access our site for any purpose; (b) that you will not take any action that imposes or may impose (at Certilogo's sole discretion) an unreasonable or disproportionately large load on our infrastructure; (c) that you will not interfere or attempt to interfere with the proper working of our site, services, or tools, or any activities conducted on or with the site, services, or tools; (d) that you will not bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the site; (e) that you will not make repeated requests for authentication of the same identification code; (f) that you will provide complete and correct information when using our Services; (g) that you will not register to our Service using more than one registration ID; (h) that you will not take any action aimed at reverse engineering our Services, including but not limited to actions aimed at uncovering Certilogo's item-level identification and product authentication methodology, and that you will not divulge or publish a CLG Code by any means other than the Certilogo Seal of Authentication (SoA); (i) that you will not make available on this site any offensive or illegal content, in which respect you are fully and exclusively responsible. You acknowledge that in case of abuse or improper use of our Services the responses provided by Certilogo to requests for product authentication could be incomplete and/or incorrect and that Certilogo may, at its sole discretion, limit, suspend, or terminate its Service, prohibit access to its sites and their content, services, and tools, delay or refuse authentications and fake reports, deliver negative, incomplete or incorrect responses to requests for authentication, and take technical and legal steps to protect its rights and keep users off the site if it thinks that they are creating problems or possible legal liabilities, infringing any intellectual property right or any applicable law, or acting inconsistently with the letter or spirit of its policy.

Certilogo S.p.A. having its registered office in Milan, Via Leopardi, 1, Italy ("Certilogo", "we" or "us"), takes your privacy very seriously. Certilogo owns and operates the web site located at www.certilogo.com (the "Web Site") and provides a Product Authentication Service to the users who register to the Web Site.

This Privacy Policy, which may be updated from time to time, is drafted in accordance with article 13 of Legislative Decree 196/03 and is intended to inform you about: the information that is collected from you when you visit and register to the Web Site; how this information may be used and disclosed; how you can control the use and disclosure of your information; and how your information is protected. However, when you use certain Web Site's functions such as if you wish to use our Product Authentication Service or each time you contact us by clicking one of the links in the "FAQ - Contact Us" section, we may ask for certain personal information from you for the purpose of providing to you content and/or services that you request. We may retain a record of users who have used our Product Authentication Service or who have contacted us in order to provide the requested service/s, to respond properly to questions or concerns and for purposes of future communications. We will never and under no circumstances collect whatsoever information related to your religious beliefs, your sexual orientation, your political views and your financial standing and / or other sensitive data as defined by the Applicable Law.

Information We Collect When You Visit and Interact With the Site. Cookies/ Web server logs / Geo-localization. Our Web Site utilizes standard technology called "cookies" and Web server logs to collect information about how our Web Site is used. Save as otherwise expressly provided, we will process your personal data (i) to fulfill your request or (ii) to provide you with the services or contents that you have requested and to send you information and updates related to our services or (iii) to perform the Site's Terms and Conditions or (iv) to comply with an obligation imposed by a law or regulations (v) to identify possible commercial frauds and help our business clients to contrast those frauds. Except for the personal data required by the applicable law, providing such data to us is not mandatory. Nevertheless, should you fail to reply, we may not be able to fulfill your request or provide you with the services or contents that you have requested, or perform the Site's Terms and Conditions.

SUBJECTS WHO MAY HAVE ACCESS TO THE INFORMATION
We may employ other companies, agents and contractors, as well as individuals acting as external data processors, to perform functions on our behalf.

Our employees, acting as internal data processors or persons in charge of the processing, as well as our third parties providers who have access to personally identifiable information, are required to protect the information in a manner that is consistent with this Privacy Policy and with the instructions provided by us.

We may provide access to your personally identifiable information when legally required to do so, to cooperate with police investigations or other legal proceedings, to protect against misuse or unauthorized use of our Web Site, to limit our legal liability and protect our rights, or to protect the rights and safety of visitors to this Web Site or the public. When you request the Product Authentication Service, we may communicate the outcomes of the Product Authentication Service and the verdicts concerning the authenticity of your products to the third parties partners whose product you have purchased/are interested in and in relation to which you have requested the Product Authentication Service for investigation purposes post authentication.

With your optional, prior and express consent, we may transfer your personally identifiable information to third parties partners whose product you have purchased/are interested in and in relation to which you have requested the Product Authentication Service. Such third parties partners will act as autonomous data controllers and will use your personally identifiable information for their own marketing and profiling purposes. Such third parties partners can be for example fashion and accessories companies, as well as design companies, food & wine producers, cosmetics and beauty companies, health care companies and you can find a detailed list of them and of their respective privacy policies by clicking on the following link. Your consent to this processing is optional and refusing it will not compromise the possibility to use the Web Site and the services or contents that you have requested.
HOW DO YOU ACCESS AND/OR MODIFY YOUR INFORMATION OR CHOICES?
